Terms and Conditions

Vickco Mulching & Land Solutions
By requesting services from Vickco Mulching & Land Solutions (“Company,” “we,” “us,” or “our”), you (“Customer”) agree to the following terms and conditions.

1. Scope of Work
All work performed will be based on the scope discussed during the site evaluation and agreed upon in writing or electronically. Any changes to the scope of work must be approved by both parties and may result in additional charges.

2. Site Conditions and Access
Customer is responsible for providing clear access to the work area, including gates, driveways, and entry points. Delays or additional work caused by limited access, soft ground, or undisclosed conditions may result in additional charges.

3. Underground and Hidden Hazards
Customer is responsible for identifying and marking all underground utilities, septic systems, irrigation lines, wells, culverts, and other hidden hazards prior to work beginning.

Vickco Mulching & Land Solutions is not responsible for damage to unmarked or undisclosed underground items.

4. Property Damage Expectations
Forestry mulching, land clearing, grading, and heavy equipment work may cause ground disturbance, including ruts, soil displacement, or surface scarring, especially in wet or soft conditions. While we take care to minimize unnecessary disturbance, such impacts are inherent to the work and are not considered damage.

5. Finish Expectations
Finish level expectations (rough clearing, walkable finish, ready for grading, or planting prep) must be agreed upon prior to work starting. Natural variations in terrain, vegetation, and soil conditions may affect final appearance.

6. Weather and Ground Conditions
Work schedules and results are subject to weather and ground conditions. Wet or unstable ground may require rescheduling or result in additional ground disturbance. Weather-related delays do not constitute breach of contract.

7. Debris and Mulch
Unless otherwise agreed, mulch and cleared material will be left on site. Debris hauling or removal is not included unless specifically stated in the estimate.

8. Estimates and Pricing
All estimates are based on visible conditions at the time of evaluation. Hidden obstacles, heavier vegetation, or changes in site conditions may require pricing adjustments. Estimates are not guaranteed unless stated in writing.

9. Payment Terms
Payment terms will be provided with the estimate or invoice. Payment is due upon completion unless otherwise agreed in writing. Late payments may be subject to fees or collection costs.

10. Deposits and Booking
A deposit may be required to secure scheduling for services. Work is not considered booked until the required deposit is received. Deposit amounts will be communicated at the time of estimate or scheduling.

11. Cancellations and Rescheduling
Cancellations or rescheduling requests must be made as early as possible.
Deposits are non-refundable within five (5) days of the scheduled service date due to equipment scheduling, labor planning, and lost availability.
Cancellations made more than five (5) days prior to the scheduled date may be eligible for deposit refund or credit at the Company’s discretion.
Weather-related delays or Company-initiated rescheduling will not result in forfeiture of the deposit.

12. Liability Limitations
Vickco Mulching & Land Solutions is not responsible for damage to unmarked hazards, pre-existing conditions, or items located within the work area that were not disclosed prior to service. Our liability is limited to the amount paid for the specific service performed.

13. Safety
Customer agrees to keep all persons, pets, and livestock clear of the work area while equipment is operating. The Company reserves the right to stop work if unsafe conditions exist.

14. Photographs and Marketing
The Company may take photographs or video of the work area before, during, or after completion for documentation or marketing purposes unless the Customer requests otherwise in writing.

15. Governing Law
These terms are governed by the laws of the State of Alabama.

16. Acceptance of Terms
By requesting or authorizing services from Vickco Mulching & Land Solutions, Customer acknowledges and agrees to these Terms and Conditions.

17. Authorization to Request Services
By booking services, the Customer represents and warrants that they are the legal owner of the property or have full authority from the legal owner to authorize the requested work. Vickco Mulching & Land Solutions assumes no responsibility for disputes, claims, or damages arising from work performed without proper authorization.

18. SMS and Electronic Communication Consent
By providing a phone number and requesting or scheduling services, the Customer consents to receive calls, text messages (SMS), and electronic communications from Vickco Mulching & Land Solutions related to estimates, scheduling, project updates, billing, customer service and future marketing.

Message frequency may vary. Standard message and data rates may apply. Consent to receive text messages is not a condition of purchase.
Customers may opt out of SMS communications at any time by replying STOP to any message or by contacting the Company directly.

Changes to Terms and Conditions
The Company reserves the right to revise these Terms and Conditions at any time without prior notice. Continued business with Vickco Mulching & Land Solutions following any updates constitutes the Customer’s agreement to the revised terms.
